If you are planning on making alterations to your property that involve alterations to a shared fence or wall; or if you are building a new structure on your property that abuts or is adjacent to your neighbour’s, then it will be necessary to serve Party Wall Notice on that neighbour. This is a requirement of the Party Wall etc Act, 1996. At the end of this process we will publish a Party Wall Award, which is a legal document that sets out the conditions under which works can take place, including access arrangements to enable the works; working days and hours; and a record of the condition of finishes in any qualifying neighbouring buildings prior to works beginning.

Many people underestimate the importance of the Party Walls process, perhaps seeing it as a pointless formality. That could not be furthers from the truth: a party wall award protects the interests of both parties. For the Building Owner, it protects them from spurious claims of damage from the neighbours. And for the neighbour, it means that any damage that can be shown to arise from the works, will be repaired at the responsibility and cost of the owner of the property being worked on.
